Members are advised, the NSW Government is proposing further changes to the timing of regulatory amendments affecting the building industry. These proposed timeframes represent a further deferment of amendments previously communicated in 2025.

 

While a formal decision is still pending and remains subject to NSW Government approval, the Minister for Building, the Hon. Anoulack Chanthivong MP, has endorsed notifying key stakeholders of the following proposed changes.

 

These proposed amendments are intended to provide additional time for industry preparation and implementation.

 

  • Expansion of the Design and Building Practitioners Act: The expansion to include Class 3 and 9c remedial, renovation and alteration work, previously deferred to 1 July 2026, is now proposed to be further deferred to 1 July 2028.
  • Professional indemnity insurance requirement for building practitioners: The current exemption from holding professional indemnity insurance, previously extended to 30 June 2026, is now proposed to be further extended to 30 June 2027
  • Increase to the Strata Building Bond: The increase in the Strata Building Bond from 2 per cent to 3 per cent, previously deferred to 1 July 2026, is now proposed to be further deferred to 1 July 2028.

 

The NSW Government are providing this advice to a limited group of stakeholders to support forward planning. Broader communication will occur once arrangements are finalised and formal approvals are complete. Any approved amendments will be published on the NSW legislation website and will email further updates.
